Who gets holiday pay
- You must have been employed for at least 90 calendar days in the 12 months before the holiday.
- You are not entitled if, without reasonable cause, you fail to work your scheduled day before or after the holiday, or agreed to work the holiday and did not.
How holiday pay is calculated
Holiday pay is your regular wages for the day. If your daily wages vary, it is your average daily earnings (without overtime) over the days you worked in the 30 calendar days before the holiday. An employer can instead pay 4% of wages to cover holiday pay.
Working on the holiday: If you work the holiday you get 1.5 times your wage for the hours worked, plus your regular day’s pay if you are entitled to the holiday. Hotels, restaurants and continuous operations may pay regular wages plus a day off instead.
When a holiday falls on a weekend or your day off
If a holiday falls on your non-working day or during your vacation, you get your regular day’s pay (if you agree) or a designated working day off with pay before your next vacation.
